Difference Between Divorce Legal Separation, and an Annulment


A divorce is also referred to as ”dissolution of marriage."  A divorce legally ends your marriage.  A divorce usually requires a lot of paperwork which includes child custody, child visitation, and child support.  There is less documentation if there are no children involved in the marriage.  A divorce will allow the court to determine how property and assets will be divided and who will or will not pay spousal support.  Other court orders may be incorporated.

A legal separation is different from a divorce because a legal separation does not end a marriage.  A legal separation simply allows a married couple the ability to live separate and apart while deciding on parenting, property, and financial issues.

An annulment is also referred to a as "nullity of marriage."  The court may grant an annulment if it is found that the marriage is not legally valid.  A bigamous or incestuous marriage is always invalid.  A marriage may also be "void" if one of the spouses was already married, not of legal age to marry, or due to force, fraud, physical incapacity, or mental incapacity.
